These Terms of Use (“Terms”) govern your access to and use of the Oerdanta website, including any mobile version of the website (collectively, the “Site”). The Site is owned and operated by Oerdanta (“Oerdanta,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Notice. If you do not agree, please do not use the Site.

If you make a purchase through the Site, your purchase is governed by our Terms of Purchase, which are incorporated by reference.

e) Upload or transmit viruses, malicious code, or anything that interferes with the Site’s operation or security.

We may suspend or terminate access to the Site at any time for any reason, including suspected misuse or violation of these Terms.

    If you submit content to the Site (such as reviews, photos, comments, or messages) (“User Content”), you represent that you own or have the right to submit it and that it does not violate any law or third-party rights.

To the extent permitted by law, you grant Oerdanta a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in any media for operating, marketing, and improving the Site and our services.

User Content is not treated as confidential, and we are not responsible for any User Content posted by users.

Because we sell gardening products including live plants, you acknowledge that natural variation can occur and plant growth/appearance may differ due to environmental conditions. Product images are for reference and presentation purposes.

  1. Limitation of Liability
    To the maximum extent permitted by law, Oerdanta and its affiliates, officers, employees, suppliers, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Site or any products purchased through the Site.

To the extent permitted by law, Oerdanta’s total liability for any claim related to the Site will not exceed the amount you paid to us for the product(s) giving rise to the claim, or USD $100 if no purchase was made, whichever is greater.

    d) Your User Content.

    These Terms are governed by applicable laws, without regard to conflict-of-law rules.
    If a dispute arises, you agree to first contact us to attempt to resolve it informally. If not resolved, disputes will be handled in accordance with applicable law and jurisdictional requirements.
